Gardening Club Terms & Conditions

  1. Introduction
    1. The Hillier Gardening Club (the ‘Club’) rewards members with points when they make qualifying purchases at Hillier Nurseries Ltd. Those points are periodically converted into vouchers which can be spent at Hillier Nurseries.
    2. A ‘Member’ means any person who has been registered with an Account for the Club pursuant to clause 2.1.
    3. These terms and conditions (the ‘Conditions’) explain how you can earn points and receive reward vouchers.
    4. If you register with the Club you are required to accept these Conditions.

  2. Joining the Club and Termination
    1. Your name and full postal address must be provided to register for a Club membership account (‘Account’). You may also supply an email address and phone number, though these are not a requirement for membership.
    2. Applicants must be aged 18 or over and must have a resident UK address.
    3. The Club reserves the right to refuse an application at its sole discretion. Members are responsible for keeping their personal and contact details on their Account up to date.
    4. The Club may issue you with a physical membership card linked to your Account (‘Card’) which remains the property of the Club. It must be returned to the Club on request or destroyed when no longer valid for use.
    5. If you do not hold an Account you will not become a Member or receive any points.
    6. If the Club reasonably believes that you have breached these Conditions and/or abused the Club, your Account may be closed and your membership terminated without prior notice.
    7. The Club reserves the right to take any action deemed necessary where membership is found to have been used in a way that abuses the Club.
    8. The Club also reserves the right to:
      1. stop issuing Cards or registering new Members with an Account at any time;
      2. on notice to you, alter or amend these Conditions of operation of the Account and/or Club;
      3. merge any Accounts that appear to be duplicate Accounts with the same name and address and where one Account has not been active for a period of time;
      4. amend, withdraw or cancel the Account and/or the points (including the value, redemption and issue of such). Inactive Accounts, where no purchase has been made online or in store with the Account or Card linked to it in any 5 year period, will be terminated. The Club will give prior notice of closure by email where the Account is registered with a valid email address; and
      5. on prior notice to you, stop operating the Club.
    9. You may terminate your membership at any time by emailing club@hillier.co.uk. Following termination, all points on the Account and vouchers issued shall be lost.
    10. You are responsible for the security of your Account and Card and all vouchers issued on that Account and Card. If you believe an unauthorised person has compromised the security of the Account or Card by, for example, its theft or the theft of personal or password information relating to it you should contact the Club as set out in section 6 immediately. Lost, damaged or stolen Cards can be replaced by visiting your local Hillier Garden Centre or contacting the Club as set out in section 6. The Club is not responsible for any unauthorised use of the Account, Card or any lost or stolen vouchers.
    11. An Account and any points on it are non-transferable and can only be used by the registered Account holder.
    12. The Club is not open to employees of Hillier Nurseries Ltd.

  3. Points and Reward Vouchers
    1. Collect points at any Hillier Garden Centre or the Hillier Online Shop. To collect points you must present your Card or Account details at the checkout at the time of purchase. If you forget to present your Card or Account details then you can:
      1. for online purchases, email club@hillier.co.uk up to 28 days from the date of purchase to have the missed points credited to your Account; or
      2. present a valid till receipt at a Hillier Garden Centre up to 28 days from the date of an in-person purchase to have the missed points credited to your Account.
      However, you cannot claim points on purchases made before you joined the Club.
    2. Points will be awarded on all goods sold in Hillier Garden Centres, with the exception of gift vouchers, delivery charges, products from concessions and other products from time to time as notified.
    3. Product discounts related to, and offered as part of the Club are not valid for redemption against the excepted goods noted in section 3.2.
    4. You will receive points on qualifying transactions in Hillier Garden Centres and the Hillier Online Shop. The rate at which you earn points is stated on the following web page: https://www.hillier.co.uk/gardening-club/. These rates can be altered at the Club’s discretion on reasonable notice. The Club reserves the right to give such notice via post, email or our website. The Club may also display notices detailing any variation to the points earning ratio in its garden centres. The number of points issued may vary between qualifying purchases.
    5. The Club reserves the right to offer bonus points on certain products as selected by the Club from time to time in its sole discretion.
    6. The Club reserves the right to terminate any points offers, including but not limited to such points offers referred to at section 3.5 above, at its sole discretion. The Club will give Account holders reasonable notice of any decision to terminate or vary any points offers. The Club reserves the right to give such notice via post, email or our website. The Club may also display notices detailing any termination or variation to any points offers in its garden centres.
    7. Each point has a redemption value as set out on the following web page: https://www.hillier.co.uk/gardening-club/ and will count towards your reward voucher. The Club reserves the right to vary the rates at any time on reasonable notice. The Club reserves the right to give such notice via post, email or our website. The Club may also display notices detailing any variation to the points redemption value in its garden centres. All points awarded and all reward vouchers issued have no monetary value.
    8. Twice a year your online Account will be issued with vouchers reflecting the number of points in your Account. You must have a qualifying points balance of at least £0.50 to receive a voucher. Points are automatically converted into vouchers carrying a specific cash discount or benefit. Each voucher will have an expiry date specified on it and will be subject to any other terms and conditions stated on the voucher or otherwise publicised by us. Any points which are not converted will be carried forward.
    9. Points expire 2 years after you earn them and are lost if the relevant Account is closed or the Club ends, noted in section 2.8.
    10. The Club may optionally send you copies of vouchers by email or post. The Club shall not be responsible for vouchers lost in the post or rejected via email.
    11. The Club is entitled to vary the qualifying points balance and the number of mailings a year, from time to time at its sole discretion. The Club will give Account holders reasonable notice of any variation to the qualifying points balance and/or the number of mailings a year. The Club reserves the right to give such notice via post, email or our website. The Club may also display notices detailing any variation to the qualifying points balance and/or the number of mailings a year, in its garden centres.
    12. If the Club reasonably suspects abuse, fraud or misconduct in respect of use of the Account, it may refuse to issue and/or cancel points or vouchers. You may not rely on any human or software error which results in the award of points or vouchers to which you are not entitled under these Conditions.
    13. Vouchers are personal to you, non-transferable and cannot be exchanged for cash. They can only be used when presented with the registered Card or Account. Vouchers that the Club deems to be damaged, defaced or photocopied will not be accepted.

  4. General Terms
    1. The Club may vary these Conditions on reasonable notice. The Club reserves the right to give such notice via post, email or our website. The Club may also display notices detailing any variations to these Conditions in its garden centres. Earning further points or using vouchers following such variation shall constitute acceptance of the changes the Club makes.
    2. If the Club decides to transfer the scheme to another legal entity it may transfer all of its rights and obligations under these Conditions without your consent and may disclose information about you to any potential or new owner (in accordance with our Privacy Policy).
